In October 2023, Carla and Michael reached out to our office seeking assistance. They desired Michael to adopt Carla's son, Dylan. Carla and Michael had been married since 2012, with Michael serving as a stable father figure in Dylan's life since 2010. During this time, Dylan's biological father, Eric, intermittently entered Dylan's life, causing upheaval for Dylan and the entire family. Despite this, Eric failed to meet his obligations, including child support payments. Between November 2018 and October 2023, Eric appeared to vanish.
For Carla, Michael, and Dylan, the stakes were significant. They sought legal resolution to establish Michael's role as Dylan's father and ensure Dylan's stability and security. The uncertainty surrounding Eric's potential return and refusal to consent added complexity to the situation.
Recognizing the urgency of the situation, our legal team swiftly pursued a stepparent adoption for Michael. This approach emphasized Eric's abandonment of Dylan, rendering his consent unnecessary. Concurrently, we formulated contingency plans to obtain a new custody order and pursue increased child support if Eric resurfaced and refused consent.
Through diligent investigative work, Eric was located and served, but he failed to respond. Subsequently, an order of default was granted against Eric. Working in tandem with DHS, we navigated background checks and Indian Child Welfare Act (ICWA) verification processes, expediting the home study and waiving the 90-day waiting period.
Upon finalization of the judgment, Dylan opted to have a new birth certificate issued, reflecting Michael as his father. Dylan also adopted Michael's last name, solidifying their familial bond. The successful adoption brought joy to Carla, Michael, and Dylan, securing Dylan's future within a loving and supportive family environment.
